Is your property subject to an Expropriation?
Expropriation describes the process where a landowner is forced to lose ownership of their property to an “expropriating authority,” for government use or where the government authorizes it. An expropriation may take all of a property, part of a property, or it may take only a partial interest in a property, for example, an easement or subterranean rights.
A landowner must be compensated for any property that is taken, but disputes can arise about the value of that property and the amount of compensation that the owner is entitled to. The term landowner, or “owner,” includes registered property owners, tenants, mortgagees, or any person otherwise entitled to an interest in the property.
The Expropriations Act
The principal behind the Expropriations Act is that a landowner should be made “whole”. Therefore, in addition to compensation for the market value of the lands, interest, and provable business and disturbance damages resulting from the expropriation, the Act provides that the expropriating authority must reimburse an owner for reasonable legal, appraisal and other costs.
